End User License Agreement
This End User License Agreement ("Agreement") is a binding agreement between you ("End User" or "You") and Risky Text ("Company"). This Agreement governs your use of Risky Text (the "Application").
1. License Grant
Company grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the Application strictly in accordance with the terms of this Agreement.
2. Restrictions
You agree not to, and you will not permit others to:
- License, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose or otherwise commercially exploit the Application or make the Application available to any third party.
- Modify, make derivative works of, disassemble, decrypt, reverse compile or reverse engineer any part of the Application.
- Remove, alter or obscure any proprietary notice (including any notice of copyright or trademark) of Company or its affiliates, partners, suppliers or the licensors of the Application.
3. Intellectual Property Rights
The Application, including without limitation all copyrights, patents, trademarks, trade secrets and other intellectual property rights are, and shall remain, the sole and exclusive property of Company.
4. Subscription Terms
Risky Text offers an auto-renewing monthly subscription. Payment will be charged to your Apple ID account at the confirmation of purchase. The subscription automatically renews unless it is canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel your subscriptions by going to your App Store account settings after purchase.
5. Uncensored Language Model and Explicit Content
The Application uses an uncensored language model to generate text messages based on user prompts. You acknowledge and agree that:
- The Application may produce explicit, offensive, or inappropriate content if prompted to do so.
- You are solely responsible for the prompts you provide and the content you generate using the Application.
- You will not use the Application to generate content that is illegal, harassing, abusive, or violates the rights of others.
- The Company is not responsible for any content generated by the Application, regardless of the nature of that content.
- You will not use the Application to generate content for minors or share explicit content generated by the Application with minors.
- You will comply with all applicable laws and regulations regarding the generation and sharing of explicit content.
6. Age Restriction
Due to the potential for explicit content, this Application is strictly for users 18 years of age or older. By using this Application, you confirm that you are at least 18 years old.
7. Disclaimer of Warranties
The Application and all content generated by it are provided "as is" and "as available" without warranty of any kind. The Company explicitly disclaims all warranties, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
8. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall the Company be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the Application or any content generated by it.
9. Indemnification
You agree to indemnify, defend, and hold harmless the Company from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney's fees and costs, arising out of or in any way connected with your access to or use of the Application and any content you generate using the Application.
10. Termination
This Agreement is effective from the date you first use the Application and shall continue until terminated. You may terminate it at any time by uninstalling the Application and all copies thereof from your devices. It will also terminate immediately if you fail to comply with any term of this Agreement. Upon such termination, the licenses granted by this Agreement will immediately terminate and you agree to stop all access and use of the Application.
11. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of New York, USA.
12. Changes to This Agreement
The Company reserves the right, at its sole discretion, to modify or replace this Agreement at any time.
